1 – Scope and object of the general conditions
These General Conditions are intended, with the order form, and the other elements referred to therein, to regulate the terms and conditions governing the provision of the Online Store Service - NIO Portugal - represented by Ultra Convenience Lda, with registered office at Rua Azinhaga das Galhardas, 17, Bloco A, 9 B, 1600-097, Lisbon, with the tax identification number 516012819, hereinafter referred to as NIO Portugal.
The Service consists of providing, through the address www.niococktails.pt, access to the Online Store, which, in addition to providing information on a set of products and / or services, allows the User / Consumer, by electronic means, to order the products on it disclosed, under the terms and conditions described herein.
The ordering of products must be made by Users / Buyers aged 18 (eighteen) years or older (individuals under the age of 18 must have authorization from their representatives). The elements and information transmitted by the User / Consumer will enjoy full legal effects, the User / Consumer recognizing electronic purchases, and the latter cannot claim the lack of signature for non-compliance with the obligations assumed. The total price of the good or service (in detail) will be displayed, including taxes and fees, additional transport charges, postal or delivery charges or any other charges. Exceptions are made here for charges arising from the conclusion of the contract that resulted in an unexpected way.
All NIO Portugal e-commerce products and services are only available for Portugal.
2 – Notices, modifications and cancellation of services
NIO Portugal may provide notices to Users / Buyers via email, telephone, regular mail or news at its Internet address. NIO Portugal reserves the right to modify, suspend or terminate any services at any time.
NIO Portugal can also change these terms and conditions at any time, by posting your changes to your internet access address.
3 – Product information and content
NIO Portugal will do everything possible so that the information presented does not contain typographical errors, and will be quickly corrected whenever they occur. If you purchase a product that has characteristics different from those presented online, you have the right to terminate the purchase contract under the applicable legal terms.
NIO Portugal will do everything possible to send all the products ordered, but it is possible that, in certain cases and due to causes difficult to control by NIO Portugal, such as human errors or incidents in the computer systems, it is not possible to make available any of the products requested by the User /Consumer. If any product is not available after placing the order, you will be notified by email or telephone. At that time you will be presented with the possibility to cancel the order with the respective refund, if you have already made the respective payment. The order can be delivered from the next two business days, after it made available to the delivery service as previously indicated by the User / Consumer at the time of checkout. In case of non-compliance, NIO Portugal must inform the customer about the unavailability of the product and refund the amounts paid within a maximum period of (10 days) from the date of knowledge of that unavailability.
All information on prices, products, specifications, promotional actions, services and other content may be changed at any time by NIO Portugal, with no obligation to make any prior communication to Users / Buyers.
4 – Delivery time and shipping costs
4.1. Delivery time
NIO Portugal will deliver the order as previously indicated by the User / Consumer at the time of checkout and at the given address.
After processing the order, the User / Consumer will receive via e-mail confirming the order with the day and period for delivery, within what was informed by the same.
4.2. Shipping costs
NIO Portugal will deliver the User / Consumer order, exclusively in Portugal Continental. In the event of a request by the User / Consumer, for a delivery to be made outside the zone indicated above, the extra postage costs will be borne by the same who request it.
5 – Order cancellation
5.1. At the request of the User / Consumer
The User / Consumer may cancel his order by requesting it from NIO Portugal by e-mail email@example.com mentioning the order number, which will be accepted as long as it has not yet been processed. After processing, NIO Portugal will analyze the order, as long as it is in accordance with item 7.1.
For the purpose of cancellation the User / Consumer must indicate the following data to NIO Portugal:
1 - Order number;
2 - Name and number of taxpayer with which you placed the order and delivery address.
5.2. By decision of NIO Portugal
NIO Portugal reserves the right not to process orders when it finds any inconsistency in the personal data presented or observes misconduct on the part of the User / Consumer. NIO Portugal reserves the right not to process any order or refund, in the event of errors in the values and / or characteristics of the products, when these arise from technical problems or errors unrelated to NIO Portugal.
6 – Payments
The User / Consumer has at his disposal the following payment methods:
6.1. Credit / debit card - Through the Stripe payment institution, you must provide the credit card details on the platform, and after payment confirmation, the order will be processed. If payment is not made within a few minutes, your order will be considered suspended.
6.2. Multibanco and MBWay - Through the Ifthenpay payment institution, you must provide the data on the platform, and after payment confirmation, the order will be processed. If payment is not made within a few minutes, your order will be considered suspended.
7 – Repentance Law
7.1. The User / Consumer will be granted the exercise of the right to regret the purchase.
- a) The withdrawal period is 2 (two) hours from the processed purchase (payment made);
- b) In case of withdrawal or regret, the User / Consumer should contact NIO Portugal by the available means.
7.2. The cancellation of the purchase will be provided and the full purchase amount will be refunded.
7.3. For purchases with a credit card, the card administrator will be notified and the refund will occur on the next or subsequent invoice. The reimbursement period and, still, the collection of the remaining installments after the full refund of the Product value on the User / Consumer credit card carried out by NIO Portugal, is the responsibility of the card administrator. In the event of future installments being charged by the card administrator, the User / Consumer will not be exonerated, since NIO Portugal, as mentioned above, reverses the full value of the Product in a single payment, the credit for the refund being granted entirely by the card administrator on the billing invoice subsequent to the month of cancellation.
7.4. NIO Portugal evades the obligation to cancel any product requested by the User / Consumer, which does not meet the conditions stipulated in the aforementioned items.
8 – Exceptions to the right of free resolution
Unless the parties agree otherwise and in accordance with the law in force, the consumer may not freely resolve contracts for the supply of sealed goods that cannot be returned, for reasons of health or hygiene protection when opened after delivery by the User / Consumer.
9 – Alternative resolution of consumer disputes
